Governments worldwide are tightening digital accessibility rules, turning what was once a best practice into a legal mandate. In the U.S., the Department of Justice's April 2024 rule under ADA Title II sets enforceable standards for state and local governments' websites and apps. Larger entities—those serving 50,000 or more people—must comply by April 24, 2026, with smaller ones following in 2027. This shift replaces vague civil rights obligations with WCAG 2.1 Level AA, a standard covering alt text for images, keyboard navigation, and color contrast.

Across the Atlantic, the European Accessibility Act (EAA) took effect on June 28, 2025, harmonizing requirements across 27 EU nations. It applies to private sector products like e-commerce platforms, banking apps, and transport services sold in the EU, regardless of a company's location. Non-compliance can lead to fines of €5,000 to €20,000 per violation, product recalls, or market exclusions. In the UK, post-Brexit, the Equality Act 2010 and Public Sector Bodies Accessibility Regulations enforce similar standards, with WCAG 2.2 increasingly adopted.

The human toll is stark: over 1 billion people globally live with disabilities, including 61 million U.S. adults and 16 million in the UK. Inaccessible sites bar them from jobs, education, and services—think screen readers failing on poorly coded forms or videos without captions. Businesses suffer too, with U.S. lawsuits jumping 37% in early 2025 to over 2,000, and full-year totals surpassing 5,000. Settlements average $25,000, but legal fees and remediation can push costs to $100,000 or more. E-commerce, hit hardest, faces repeat suits: 1,427 of 2025's cases targeted prior defendants.

Less obvious tensions lurk in solutions. AI tools, now used by 82% of organizations, automate audits and fixes but can generate errors—like inaccurate image descriptions—leading to 'accessibility theater' that passes scans but fails users. Overlays, quick-fix software, draw DOJ scrutiny for ineffectiveness, favoring inclusive design from the start. Stakeholders clash: developers push for built-in tools, while advocates demand human testing. Surprising data shows accessible sites boost revenue by 75% for some firms, tapping underserved markets. Yet, small businesses, lacking resources, risk disproportionate burdens amid enforcement gaps.
