Immigration enforcement has surged under the second Trump administration, making Form I-9 compliance a critical risk for U.S. employers. With ICE ramping up audits and raids, businesses face unprecedented scrutiny over hiring practices.
The administration, inaugurated in January 2025, prioritized aggressive interior enforcement. ICE hired 10,000 additional agents to accelerate deportations and workplace inspections. This shift reversed the more lenient approach of the prior four years, signaling zero tolerance for unauthorized employment.
Fines for I-9 violations escalated in 2025. Paperwork errors now cost between $288 and $2,861 per form. Knowingly hiring or continuing to employ unauthorized workers triggers penalties from $716 to $28,619 per individual, with repeat offenders facing the maximum. ICE increasingly uses AI-driven audits to detect inconsistencies, amplifying the reach and speed of investigations.
A notable case in 2025 saw three Colorado janitorial companies fined over $8 million for employing 143 unauthorized workers. The action stemmed from a routine I-9 audit, not a raid, highlighting how even administrative reviews can lead to massive liabilities. Industries like cleaning services, agriculture, and construction, which rely heavily on immigrant labor, have been hit hardest.
Employers must respond to ICE Notices of Inspection within three business days, producing all I-9 forms. Failure invites civil fines, criminal charges, or debarment from federal contracts. Electronic I-9 systems require updates by July 31, 2026, to the version expiring May 31, 2027, adding urgency for tech-dependent firms.
Workers are directly impacted. Unauthorized individuals risk arrest during raids, with over 650 charged by February 2026 for interfering with agents under broad federal statutes. Even legal immigrants face heightened verification, especially with changes to Temporary Protected Status. TPS for Haiti ended in February 2026, affecting thousands, while a court order extended Venezuelan protections through March 2025.
Broader effects ripple through the economy. Workforce shortages disrupt operations in key sectors, potentially raising costs and slowing growth. Small businesses, often lacking robust HR systems, are particularly vulnerable to these enforcement waves.
